1. Acceptance of terms
These Terms & Conditions apply to your use of the PixelProfiter website and to any services we provide. By using this website, sending us an enquiry or engaging our services, you agree to these terms. If you do not agree, please do not use this website or our services.
2. Our services
PixelProfiter provides website development, custom software development, Android & iOS app development, digital marketing, UI/UX design, branding and graphic design, and related support services. The exact scope, deliverables, timeline and price for each project are agreed in a written proposal, quotation or agreement ("Proposal") shared with you before work begins.
If anything in a signed Proposal differs from these terms, the Proposal will apply for that project.
3. Quotes & proposals
- Quotes are based on the requirements you share with us and are valid for the period stated in the quote.
- Work that falls outside the agreed scope — such as new features, extra pages or major design changes — may be charged separately. We will always confirm any additional cost with you before starting that work.
4. Payments
- Payment terms, including any advance payment and milestone payments, are set out in the Proposal.
- Work begins once the agreed advance payment is received.
- Final files, source code and live deployment are handed over once all outstanding payments are cleared.
- Delayed payments may pause ongoing work and affect agreed timelines.
- Applicable taxes are charged as per Indian law, where relevant.
5. Client responsibilities
To help us deliver your project on time, you agree to:
- Provide accurate requirements, content, images, logos and any other materials needed for the project
- Make sure you own, or have permission to use, any content and materials you give us
- Share feedback and approvals within a reasonable time
- Keep any login details we provide to you secure
6. Revisions & timelines
Each project includes the number of revision rounds stated in the Proposal. Timelines are estimates based on prompt feedback and timely delivery of content from your side; delays in feedback, content or payments may extend the timeline.
7. Intellectual property
- Once full payment has been received, ownership of the final custom designs and deliverables created specifically for your project is transferred to you, unless the Proposal states otherwise.
- Third-party items such as fonts, plugins, stock images, themes or libraries remain subject to their own licences.
- We keep ownership of our general know-how, tools, reusable code components and working methods.
- Until full payment is received, all work remains the property of PixelProfiter.
8. Portfolio rights
Unless you ask us not to in writing, we may display completed work — including screenshots, the project name and a link to the live website — in our portfolio, website and social media. We will never share confidential business information.
9. Third-party services
Projects may rely on third-party services such as domain registrars, hosting providers, app stores, payment gateways, WhatsApp, Google and Meta advertising platforms. These services are governed by their own terms and pricing, and we are not responsible for their downtime, policy changes, approvals or fees.
For digital marketing services, we work to improve your results, but we cannot guarantee specific rankings, traffic, leads or sales, as these depend on factors outside our control.
10. Support & maintenance
Any free support period after launch will be stated in the Proposal. Ongoing maintenance, updates, hosting and technical support after that period can be provided under a separate maintenance plan.
11. Cancellation
Either party may cancel a project with written notice. If a project is cancelled, you agree to pay for the work completed up to the date of cancellation. Advance payments cover work already planned and started, and are generally non-refundable unless the Proposal states otherwise.
12. Limitation of liability
We take great care in our work, but our services are provided on an "as is" basis once delivered and approved. To the extent permitted by law, PixelProfiter is not liable for any indirect or consequential loss, including loss of profit, data or business, arising from the use of our services or this website. Our total liability for any project is limited to the amount paid to us for that project.
13. Use of this website
- The content, design and graphics on this website belong to PixelProfiter or are used with permission, and may not be copied or reused without our written consent.
- Client project images are shown for portfolio purposes and remain the property of their respective owners.
- We try to keep the information on this website accurate and up to date, but we do not guarantee that it is complete or error-free.
- Links to external websites are provided for convenience; we are not responsible for their content.
14. Governing law
These terms are governed by the laws of India. Any disputes will first be addressed through good-faith discussion and, if unresolved, will be subject to the jurisdiction of the competent courts in India.
15. Changes to these terms
We may update these Terms & Conditions from time to time. Changes will be posted on this page with an updated "Last updated" date. Projects already under a signed Proposal will continue under the terms agreed at that time.
